These Terms apply to all users of the site, including but not limited to browsers, buyers, consignors, and auction participants.
2. Eligibility
You must be at least 18 years of age to register, bid, or make purchases. By using this site or participating in our auctions, you represent that you are legally capable of entering into binding contracts.
3. Auction Participation
- All auction sales are final.
- Items are sold as-is, where-is, with no warranties or guarantees unless explicitly stated in writing.
- It is the buyer’s responsibility to review descriptions, photographs, and condition reports, and to ask questions prior to bidding.
- We reserve the right to refuse or revoke bidding privileges at our sole discretion.
4. Bidding and Payment
- Winning bidders agree to pay the full purchase price, including applicable taxes and any buyer’s premium (if applicable).
- Accepted payment methods will be outlined in auction listings or invoices.
- Failure to remit payment within the stated timeframe may result in penalties, account suspension, resale of items, and/or legal action.
5. Pickup and Shipping
- Pickup details and deadlines will be provided for each auction. Same-day pickup is not guaranteed.
- Items not picked up within the designated timeframe may incur storage fees or be deemed abandoned and forfeited without refund.
- Shipping is available on select items only. All shipping, handling, and insurance costs are the responsibility of the buyer and will be billed separately.
6. Consignment Terms
- Consignments are accepted by agreement only.
- Commission rates, payout schedules, minimums, and other terms will be outlined in a separate consignment agreement.
- Consignors represent and warrant that all consigned items are legally owned and free of liens, claims, or encumbrances.
7. Website Content & Acceptable Use
- All website content—including text, images, logos, and graphics—is the property of Don Bishop Auctions & Estate Sales or its licensors and may not be reproduced without permission.
- You agree not to misuse the website or engage in fraudulent, abusive, or unlawful activity.
8. Limitation of Liability
Don Bishop Auctions & Estate Sales shall not be liable for:
- Technical issues, website outages, or bidding platform errors.
- Unauthorized account access due to failure to safeguard login credentials.
- Losses, damages, delays, or disputes involving third parties, shipping carriers, or payment processors.
9. Changes to These Terms
We reserve the right to modify or update these Terms at any time. Updates become effective immediately upon posting. Continued use of the website or participation in auctions constitutes acceptance of the revised Terms.
